These Terms & Conditions ("Terms") constitute a legally binding agreement between you and Orynt Capital SIA (Registration No: 50203703141), located at 20 Zabaku iela, Kadaga, Adazu novads, LV-2103, Latvia ("Service Provider," "we," "us," or "our"). These Terms apply to the UnSleepify mobile application (the "Application").
By downloading or utilizing the Application, you automatically agree to these Terms. If you do not agree, you must not use the Application.
UnSleepify is for informational and educational purposes only. It is not a medical device, nor is it intended to diagnose, treat, cure, or prevent any sleep disorder, disease, or medical condition. The Service Provider is not a licensed medical care provider. You should always consult with a qualified healthcare professional before making any changes to your health or sleep routines. Your use of the Application is at your own risk.
Unauthorized copying or modification of the Application, any part of the Application, or our trademarks is strictly prohibited. You may not attempt to extract the source code, translate the Application, or create derivative versions. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the exclusive property of the Service Provider.
We reserve the right to modify the Application or introduce charges for specific services at any time. Any new charges will be clearly communicated to you before they take effect. The Application processes personal data to provide its services; please refer to our Privacy Policy for details.
The Application offers premium features via paid subscriptions, managed through the Apple App Store.
Billing: All purchases are processed by Apple Inc. ("Apple"). Subscription fees will be charged to your Apple ID account at the confirmation of purchase.
Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
Refunds: To the extent permitted by law, refunds are handled exclusively by Apple according to their policies.
EU Consumers: If you are a resident of the European Union, you acknowledge that by beginning the download or use of the digital content, you express your consent to immediate performance and acknowledge that you lose your 14-day statutory right of withdrawal.
Security: You are responsible for maintaining the security of your device. We strongly advise against "jailbreaking" or "rooting" your device, as this can compromise security and cause the Application to malfunction.
Connectivity: Certain functions require an active internet connection. We are not responsible for limited functionality caused by a lack of Wi-Fi or the exhaustion of your mobile data allowance. You accept responsibility for any data or roaming charges incurred from your mobile provider.
Third-Party Terms: The Application utilizes third-party services (Google Analytics for Firebase, Firebase Crashlytics, and RevenueCat) which have their own Terms & Conditions. You are advised to review them.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. The Service Provider shall not be liable for any direct, indirect, incidental, or consequential losses or damages arising from your use of, or inability to use, the Application. This includes, but is not limited to, reliance on the Application's accuracy or the failure of your device (e.g., battery depletion).
We may terminate your access to the Application at any time without notice. Upon termination: (a) all rights and licenses granted to you will end; and (b) you must cease all use of the Application and delete it from your device.
These Terms are governed by and construed in accordance with the laws of the Republic of Latvia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Riga, Latvia. If you are a consumer residing in the EU, you also benefit from the mandatory consumer protection laws of your country of residence.
We may update these Terms from time to time. You are advised to review this page regularly. Changes are effective when posted on this page.
